Model 231
Like the parent company ADR S.p.A., in addition to adopting the Mundys Code of Ethics and the Anti-Corruption Policy, ADR Assistance, to regulate the correct performance of its activities, has also adopted its own Organisational, Management and Control Model (Model) complying with the requirement of Legislative Decree 231/2001 and developed on the respective legal subjects and operational specificities.
The Model, constantly updated in the light of the regulatory changes that have occurred, was most recently revised in 2019 taking into consideration the evolutions of the best practices of reference and the jurisprudential innovations regarding the liability of entities. The Model describes the inspiring principles and the operating methods followed for its preparation and updating, regulates the requirements, functions and powers of the Supervisory Body, as well as the characteristics of the reporting and information flow system, the sanctioning system and the methods for disseminating the Model itself within ADR Assistance and towards third parties.
The document describes the set of control and behavioral principles deemed suitable for regulating the processes for which a potential risk of committing crimes and significant administrative offenses has been detected pursuant to Legislative Decree 231 /2001. The Organizational Model has been disclosed to Company personnel, and is brought to the attention of all third parties who undertake business relations with ADR Assistance.
Supervisory body
The Supervisory Body (SB) is the body entrusted, pursuant to art. 6 of Legislative Decree 231/2001, the task of "supervising the functioning, observance and effectiveness of the Model and taking care of its updating".
The relevant circumstances for the respect and functioning of the Model itself as well as any unlawful conduct or violations of the Model must be reported to the Supervisory Body, ensuring that the reports are detailed and based on precise and consistent factual elements.
Each report received is managed by the Supervisory Body, in compliance with the provisions of art. 6 of Legislative Decree 231/2001, guaranteeing the confidentiality of the identity of the reporting party and its protection from any form of retaliation, discrimination or prejudice connected, directly or indirectly, to the report.
The Company makes alternative channels available (WEB platform, mailbox and postal address) for the transmission of reports. In particular, reports can be made:
- via the "Whistleblowing" IT platform, accessible from the website www.adr.it and via the company intranet;
